1. About us

This website, empoweredbyashley.com, is run by Empowered by Ashley ("we", "us", "our"). You can reach us at hello@empoweredbyashley.com. Real people, Monday to Friday, 9am to 5:30pm. We reply within one working day.

These terms apply to every order you place with us and to your use of this website. Please read them together with our Shipping policy, Refund policy and Privacy policy, which form part of these terms. If you are buying as a consumer, nothing in these terms affects your legal rights.

2. Your order

When you place an order, we will email you an order confirmation. That email is our acceptance of your order, and it is when the contract between us begins.

We may cancel an order if the item is no longer available, if the price or description was clearly wrong, or if we suspect fraud. If we do, we will tell you and refund you in full.

Pre-orders. Some colours may be sold on pre-order. The product page and your order confirmation show when we expect to dispatch. If that date changes, we will email you, and you can cancel for a full refund at any time before your order ships.

Quantities. We may limit how many of an item one person can buy and decline orders that appear to be for resale. If you are buying for a business, school or organisation, please use our Bulk orders page.

3. Prices and payment

Prices are shown in the currency of the country you are shopping from. UK prices include VAT. For orders delivered outside the UK, prices do not include import duties or local taxes, which may be charged by the courier on arrival (see our Shipping policy). Delivery charges are shown at checkout before you pay.

Payment is taken when you place your order, using any of the methods shown at checkout. If we find a price was clearly wrong, we will contact you before dispatch so you can either confirm the order at the correct price or cancel it for a full refund.

4. Offers and discount codes

We may change or end an offer or discount code at any time, but never for an order you have already placed. Unless we say otherwise, codes are one per order, cannot be combined with other offers, cannot be added after an order is placed and have no cash value.

5. Delivery

Delivery options, costs and estimated delivery times are set out in our Shipping policy and at checkout. Delivery times are estimates, not guarantees. Your order is your responsibility once it has been delivered to the address you gave us. If it has not arrived, please get in touch and we will look into it.

6. Returns, refunds and faulty items

Every order comes with our 30-day peace-of-mind guarantee. Our Refund policy explains how to return, swap or claim for a faulty item.

If you are a consumer in the UK, you also have a legal right to cancel your order within 14 days of delivery, and goods must be as described, fit for purpose and of satisfactory quality. Our 30-day guarantee and our two-year warranty against operational defects are in addition to these rights, not instead of them.

7. Using your alarm

Ashley is a personal safety alarm designed to draw attention and help deter an attacker. No alarm can guarantee your safety or prevent every incident. In an emergency, always contact the emergency services (999 or 112 in the UK, 112 in Europe, 911 in the US and Canada, 000 in Australia, 111 in New Zealand).

Keep your alarm charged and test it regularly as described in the instructions. It is very loud, so never set it off right next to anyone's ears, and keep it away from young children. Personal alarms are legal to carry in the UK. If you are travelling, check the local rules.

You are responsible for how you use your alarm. Please do not use it to frighten, harass or disturb other people, or in any way that breaks the law.

8. Our responsibility to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

We are not responsible for any failure of your alarm to work, or any loss that follows, where this is caused by it not being charged, tested or used as described in the instructions, by misuse, accidental damage, water damage, normal wear and tear, or by changes or repairs made by anyone other than us.

So far as the law allows, our total liability to you in connection with any order is limited to the price you paid for that order.

We do not exclude or limit our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights as a consumer, including your right to goods that are as described, fit for purpose and of satisfactory quality.

Our products are sold for domestic and private use. If you buy for business use, we are not liable for any loss of profit, loss of business, business interruption, loss of business opportunity or any indirect or consequential loss, and our total liability to a business customer is limited to the price paid for the order.

We are not responsible for delays caused by events outside our reasonable control. If one affects your order, we will tell you and do what we can to limit the delay. If the delay is significant, you can cancel and we will refund you for anything you have paid for but not received.

9. Using this website

The words, images, videos and logos on this website belong to us or to people who have allowed us to use them. Please do not copy or reuse them without our written permission.

You must not use this website for anything unlawful, give false information, or try to interfere with its security or operation. If you create an account, please keep your login details safe.

If you leave a review or send us a photo, you give us permission to show it on our website and in our marketing. We may remove content that is unlawful, offensive or misleading. Links to other websites are provided for convenience; we are not responsible for their content.

Information on this website, including safety tips, statistics and articles, is general information only. It is not professional, legal or safety advice for your particular situation.

We may suspend or withdraw all or part of this website at any time. If you break these terms or misuse the website, we may refuse service or close your account.

10. Your personal information

We use your personal information only as set out in our Privacy policy.

11. Changes to these terms

We may update these terms from time to time. The version on this page when you place your order is the one that applies to that order.

12. Governing law

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can also bring them in the Scottish courts, and if you live in Northern Ireland, in the Northern Irish courts. If you live outside the UK, nothing in these terms removes any consumer protection you have under the law of the country where you live.
